The
NSWRTM is 3801's rightful, legal, permanent, primary custodian
- the NSWRTM saved 3801 from scrapping in the 1960s, operated it
extensively until 1976, and initiated and participated in the restoration
of 3801 in the mid 1980s, prior to the formation of 3801 Limited.

A
lease from the NSWRTM and State Rail provides a 20-year fixed-term
loan of the locomotive to 3801 Limited, with no provision for
extension. 3801 Limited signed the lease willingly and knowingly
- it is 3801 Limited's responsibility to develop a business continuity
plan for conclusion of a known fixed-term lease.

The
3801 Limited lease concludes on 26 November 2006 - 3801 will
then revert to the direct custody of the NSWRTM under the 1978 Deed.
This is a legal entitlement of the NSWRTM enshrined in the Lease
and the Deed.
