Locomotive 3801 is legally in the perpetual custody of the NSWRTM under a 1978 custody Deed from State Rail.

The NSWRTM is 3801's rightful, legal, permanent, primary custodian - the NSWRTM saved 3801 from scrapping in the 1960s, operated it extensively until 1976, and initiated and participated in the restoration of 3801 in the mid 1980s, prior to the formation of 3801 Limited.

A lease from the NSWRTM and State Rail provides a 20-year fixed-term loan of the locomotive to 3801 Limited, with no provision for extension. 3801 Limited signed the lease willingly and knowingly - it is 3801 Limited's responsibility to develop a business continuity plan for conclusion of a known fixed-term lease.

The 3801 Limited lease concludes on 26 November 2006 - 3801 will then revert to the direct custody of the NSWRTM under the 1978 Deed. This is a legal entitlement of the NSWRTM enshrined in the Lease and the Deed.

The NSWRTM will:

operate 3801 widely and frequently as part of its Heritage Express rail tour family

give 3801 a viable home and display the loco at Thirlmere between trips

provide volunteer opportunities and heritage skills development

deliver sustainable, transparent management of 3801 for future generations

The NSWRTM is the leading rail heritage organisation in NSW - an open and transparent community based member and volunteer organisation with a clear vision for the future display and operation of the state's rail heritage collection.

The NSWRTM operates the state's largest rail heritage fleet, has operated main line steam trains statewide for over 30 years, and has restored four steam locomotives to service between 2001 and 2006.

The NSWRTM has the proven capacity and capability to operate 3801 into the future. The NSWRTM has largely self-funded a Museum site, 14 kilometres of heritage railway and an extensive operating fleet - including over $500,000 of Museum funds spent on the famous Southern Aurora train.

The NSWRTM's workshops are renowned for quality heavy engineering conservation and restoration work and still provide assistance, equipment and parts on request to keep 3801 operating.

Only the NSWRTM is providing a pointer to the future of 3801 - public statements by 3801 Limited dwell on the past, but have not addressed the future home, business plan, operations or overhaul of the locomotive.

3801 Limited have not offered any evidence that 3801 will face a better future with 3801 Limited.
